This Content Moderation Policy (the “Content Moderation Policy”) is incorporated by reference into the Radio Station Network End User License Agreement and Terms of RSN Service (“EULA”). The terms “RSN,” “we,” “our,” and “us” include Radio Station Network and its affiliates and or/subsidiaries. The “ RSN Service” means RSN’s proprietary RSN Services for providing end users to access audio programming from either: (a) a directory of hyperlinks to digital audio transmissions provided by third-party transmitting entities; (b) third parties engaged by RSN to provide third party programming to RSN for distribution of audio streams or to facilitate advertising insertion into audio streams; or (c) RSN. All other terms not defined in this Content Moderation Policy will have the meanings set forth in the EULA, as applicable.
At RSN, we are committed to creating a safe, transparent, and trustworthy online environment for our users. The purpose of this Content Moderation Policy is to provide you with information regarding RSN’s enhanced content moderation practices and transparency. This Content Moderation Policy applies only to users that reside in the EU, UK, or to content that is generated from providers of the RSN Service that are based in the EU or UK, and does not cover any content that is live-streamed or owned and operated by RSN under the broadcaster exception to the Digital Services Act ("DSA"). For those in jurisdictions outside of the EU or the UK, please refer to RSN’s EULA or Copyright Policy for details as to RSN’s content moderation practices and complaint processes more generally.
At RSN, we have clear and comprehensive rules and guidelines (concerning acceptable use, compliance with the law and the rights of others such as intellectual property, and safety) that any third party who wishes to use the RSN Service has to agree and adhere to. Our content review and approval practices are designed to ensure that content distributed through the RSN Service adheres to RSN’s EULA and Terms of RSN Service, Advertising Guidelines, Acceptable Use Policy, Copyright Policy, and/or Directory Terms of RSN Service for Transmitting Entities. In accordance with the DSA and UK Online Safety Act ("OSA"), we have a mechanism that allows users and stakeholders to report content they believe may violate European or UK law, the laws of individual member states, or the standards that we have set for ourselves and our content or advertising partners (“Illegal Content”). RSN does not rely on algorithmic decision-making for such content moderation review, and instead relies on a committee of human reviewers.
If you believe that any content made available on or through the RSN Service has been used or exploited in a manner that violates the DSA or OSA, please promptly send a notification of Illegal Content containing the below information to the Designated Point of Contact identified below (each a “Notice of Illegal Content”). Please note that your Notice of Illegal Content may be shared by RSN with the content provider alleged to have provided RSN with Illegal Content, and you hereby consent to RSN making such disclosure. Your communication must include substantially the following:
Representative list of such works;
Identification of the specific material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit RSN to locate the material such as a link to the exact electronic location of that information (e.g. URL);
Information reasonably sufficient to permit RSN to contact you, including your name, email address and/or physical address at which you may be contacted.
Confirmation that you are a resident of the European Union
Confirmation that the Notice of Illegal Content and the information and details contained therein are accurate and complete in good faith;
Reasonable explanation and documentation of your reasons to suggest the content in question is considered to be Illegal Content. Examples of documentation may include screenshots, images, or documents of the infringing content, such as allegedly unlawful terms and conditions, data processing, IP infringements, cases of hate speech, protection of minors or regulatory issues. If your own rights are being infringed, please upload evidence of your ownership (e.g. licensing agreements or registrations). If you believe that the reported content violates the law of your home country or EU law, please also provide us with the legal basis for the alleged violation.
*Recipients must be based in the European Union or United Kingdom in order for RSN to process a complaint under the DSA or OSA, respectively.
Repeat Infringer Policy. RSN’s policy is to (a) remove or disable access in a given territory to material that RSN believes in good faith is considered to be Illegal Content; and (b) remove or disable access to the RSN Service or transmitted through the RSN Service if you are a “repeat infringer” and terminate your right to use the RSN Service for a certain period of time (the “Suspension Period”). You are a “repeat infringer” if you have uploaded User Content or Feedback, provided an advertisement for distribution on the RSN Service, or transmitted Station Content to or through the RSN Service and for whom RSN has received more than two Notices of Illegal Content compliant with the provisions of the DSA or OSA. RSN has discretion, however, to suspend an account after receipt of a single Notice of Illegal Content or upon RSN’s own determination for users, content providers, or advertisers who frequently provide manifestly Illegal Content, including but not limited to instances in which a warning is provided by RSN and then ignored. Suspension Periods will depend on the seriousness of the violation.
Dispute Mechanism. The DSA also provides you with an opportunity to dispute the decisions that online platforms make about content and user accounts. If you believe that RSN has mistakenly taken action on your account or reported content, you may appeal our decision within six months by contacting dsa@radiostationnet.com. In addition, you may contact a certified out-of-court dispute settlement body to help resolve any dispute with us relating to our actions on your account or reported content, including if you disagree with the outcome of an appeal. The European Commission will maintain a website listing the available settlement bodies as they become certified. Decisions by out-of-court dispute settlement bodies are not binding on you or on RSN.
